U.S. Tax Court
You lost your audit or did not reach a settlement with the IRS or the state taxing agencies during your appeal. You have two choices—you can accept the decision or you can go to court.
- US Tax Court is where you can file a petition without paying the tax liability. Once the IRS issues a letter called a Notice of Deficiency, you have just 90 days to petition the Tax Court. Because of the 90-day deadline, you will want to act quickly and hire a tax professional. The Tax Court will not accept an out-of-date petition and you will not be able appeal your case in court, therefore Timing is Key.
- The Tax Tribunal (normally the name of the State Tax Court) is where you file a petition when the state taxing agencies has denied your appeal.
