U.S. Tax Court

You lost your audit or did not reach a settlement with the IRS or the state taxing agencies during your appeal.  You have two choices—you can accept the decision or you can go to court.

  • US Tax Court is where you can file a petition without paying the tax liability.   Once the IRS issues a letter called a Notice of Deficiency, you have just 90 days to petition the Tax Court. Because of the 90-day deadline, you will want to act quickly and hire a tax professional.   The Tax Court will not accept an out-of-date petition and you will not be able appeal your case in court, therefore Timing is Key.
  • The Tax Tribunal (normally the name of the State Tax Court) is where you file a petition when the state taxing agencies has denied your appeal.

Attorneys at DMG Tax Relief have extensive experience handling tax cases against the IRS and state taxing agencies. We provide experienced trial representation for businesses and individuals.
